Austin based rapper Bavu Blakes was pleasantly surprised yesterday (Tuesday, August 23rd, 2005) when he got the call from Jay Cortez of Inform Ventures, LLC (info below) announcing that he had been selected from a pool of over 2,000 submissions as a Top Ten Finalist in the Scion: Nextup contest.
According to Allhiphop.com, the “Scion: Nextup contest is holding it's second annual emcee contest which gives unsigned emcees the chance to win a $50,000 marketing deal from Scion. Judges, DJ Premier, Green Lantern and Sean Cane will filter through the applicants to find the ten best. The online contest will then feature the top 10 underground artists original songs on the Scion: Nextup site for visitors to vote on. The emcee(s) with the highest number of votes will win. Prizes include $5000 in cash, the opportunity to perform at Scion events and a fully-produced music video for their winning song.”
Bavu Blakes received an affidavit stating that he was in the Top Ten – chosen by DJ Premier, Green Lantern and Sean Cane, and that voting would commence, online, Monday August 29th on the website www.scionnextup.com.
Today, he received a call, again from Jay Cortez, stating that he had been removed from the contest because of the political lyrics in his song “Black Gold.” The lyrics in question are:
1. "Now Bush and bin Laden got so much they rotten"
2. "Texas home of the real death row"
3. "What'd we really go to Iraq fo?"
In reference to line #2, Bavu Blakes was asked if he was referring to the Los Angeles based company Death Row Records.
While we understand that any corporate entity has the right to include whoever it wants in their promotions and marketing strategies, we find it quite funny that a company so hell bent on using hip-hop to promote it’s products would have the audacity to censor an artist.
Inform Ventures, the company working with Scion on this promotion has an interesting mission statement on it’s website www.inform-ventures.com:
“Our environment is in transition. Information outlets have increased, forming a new infrastructure for the next generation. We create messages compatible with this new infrastructure then disseminate that message through our media and promotions network.”
And they censor the words of the people who they are presumably trying to reach.
Scion as a company has garnered a lot of praise and has also taken a lot of heat over the past couple of years for their co-opting of hip-hop music and culture to sell their cars. Does this action prove the nay sayers right? Find out for yourself. We feel as though Scion and Inform Ventures need to be taken to task for their decision. If they are so down with the streets and hip-hop culture then why are they trying to censor one of it’s strongest voices?
Chuck D once said that hip-hop is the CNN of the streets. If Scion and Inform Ventures can’t handle that, maybe they should just leave it alone.

This situation is not censorship. This is a company deciding that they don't want to be associated with certain lyrical content. I don't see what's so objectionable about that. Nobody is telling dude that he can't rap about this subject matter, Scion just interested in aligning themselves with a rapper that raps about this subject matter. In my mind that's their perogative. We all know that Scion or any other company that markets to or through the mythos of hip hop is doing so to sell their wares more effectively. They appropriate an image to reach a base. Why doesn't the company have the right to control their image. I emphasize their because they are not selling hip hop their using hip hop to sell their cars. They appropriate the aspects of hip hop that serve image. They aren't responsible for all of hip hop just like you and I aren't responsible for representing all of hip hop. We pick the aspects that we like and work with that.

"You may choose the subject for the Song and the style of music, but the Song may not contain, in the sole determination of Inform Ventures, LLC (the “Contest Producer”), any language or music that:

The relevant passage would seem to be part D. While I agree that Scion has the complete right to DQ Bavu, that doesn't make it any less wack. If I was Scion, I'd be embracing political rap - it would set them apart as the anti-corporate company (I know that sounds stupid) which would give them more cred with the youth market they're shooting for. section FOUR (Selection of Finalist Stage; Judging of Demo Tracks; Requirements) begins when the judges pick finalists in mid-August.
Then it moves on to (General Releases; Required Agreements)... here, you read section FOUR:
"4.Selection of Finalist Stage; Judging of Demo Tracks; Requirements
On or about August 13, 2005, a panel of qualified judges will complete their review of all eligible Demo Track entries timely received based equally on the following criteria: originality of music and lyrics (1/3), commercial viability of the Song (1/3), and overall Song appeal (1/3). The ten (10) Songs with the highest final scores given by the judges will be deemed the finalists (the “Finalists”). In the event of a tie, an additional “tie-breaking” judge will determine the Finalist based on the criteria set forth herein. The decision of the judges is final and binding.
If for any reason the Contest Producer does not receive ten (10) eligible Demo Track entries meeting the requirements of the Contest, and/or if, due to disqualifications by Contest Producer, there are less than ten (10) eligible Demo Track entries, the Contest Producer and/or judges may select less than ten (10) Finalists, or may cancel the Contest and not award the Grand Prize, at the sole and absolute discretion of the Contest Producer.
General Releases; Required Agreements
All Finalists will be contacted by telephone, mail and/or email at the numbers and/or addresses indicated in your entry submission. You (if you are entering as an individual) and all members of your performing group (if you are entering as a performing group) will be required to sign, notarize and return (within seven (7) days of Contest Producer’s issuance) an Affidavit of Eligibility, Liability/Publicity Release (unless prohibited by law), consent to background checks (as described below), and publishing, recording and performance and other licenses in form(s) designated by Contest Producer, which documentation shall state, among other things, that the entry (i) is his/her or the performing group’s own original Song, (ii) is owned by him/her or the performing group in its entirety, (iii) has not won a previous prize/award or been previously released in public, (iv) has not been previously published or recorded, and (v) does not infringe upon the rights of any third party.
Failure to execute the documents described above by the Finalists, or any member of the performing group, will result in disqualification from the Contest.
Background Checks
The Finalists (including the Submitter and all members of the performing group, if you are entering as a performing group), and, if any Submitter or performing group member is an eligible minor in his/her jurisdiction of residence, his/her parent or legal guardian, must agree to a background check (which may include a review of driving records) before they will be considered further, or permitted to be awarded the Grand Prize (described below). The Contest Producer reserves the right to disqualify any individual or performing group, if any individual or performing group member has been charged or convicted of a crime or, in the sole and absolute discretion of the Contest Producer, has engaged in past conduct that may reflect unfavorably on the Contest, the Song, the Contest Producer or the Contest Sponsor.

It seems to me that the Contest Producer (Toyota/ Inform Venture) covered their bases pretty effectively by including the following from the background check section:
"The Contest Producer reserves the right to disqualify any individual or performing group, if any individual or performing group member has been charged or convicted of a crime or, in the sole and absolute discretion of the Contest Producer, has engaged in past conduct that may reflect unfavorably on the Contest, the Song, the Contest Producer or the Contest Sponsor."
"... sole and absolute discretion of the Contest Producer" is a catch all. As ridiculous as it may be the producers could DQ my man because he bought a sweatshirt from Marshall’s in '98 because that purchase in their "sole and absolute discretion" could be deemed as an unfavorable reflection on their brand. I know it's a stupid example but it seems to me that they're within their rights to DQ ace with or without the affidavit.

1) "A person authorized...", to my knowledge Toyota nor any of it's employees have been authorized as the arbiter of objectionability (made up word) in the public domain. The song has not been banned from play on broadcast channels. The song is not being removed from record stores, online merchants, or public/private libraries. There is no penalty under law for listening to, owning or selling the song. In my estimation only a government (be it national down to local) truly has the power to censor. The distinction here is that the work is not being “suppressed” from public consumption it has only been “removed” from a privately funded competition in compliance with that competition's rules (at least in my understanding, I'm no lawyer). If there were over 2000 entrants in the competition then "Black Gold" has succumb to the same fate of at least 1,990 other songs. Does that suck for my man? Yeah, but it also sucks for 1,990 other folks as well. If "Black Gold" was censored according to your reading of Webster's definition so were those other songs.
2) If you read that definition obtusely enough you can come to the conclusion that we're all censors.

I find Mike Jones' voice and the Pharcyde's proclivity to make Momma jokes "objectionable" so I'm not going to play their records on my radio show.
Have I censored them? If I haven't, why is the decision I've made any different from what Toyota did? If I did censor Mike Jones and the Pharcyde because I found them to be "objectionable" then why is it a big deal that Toyota did it.
I think the real issue here is not censorship per say but more so about corporate appropriation of hip hop and how that appropriation has and can impact the authenticity of the music/culture (I hate using the word culture in reference to hip hop but I think it’s kind of apt in this situation). Hey but CENSORSHIP gets people’s attention. It got mine.

Looking at section four as quoted by Bavu, I still read it as being within Scion's rights to eliminate him even after being selected as a Finalist by the panel of judges. I don't think it's right - I'd love to see Bavu get some national attention - but I do think they are allowed to DQ anyone they want. Should they have made it clearer as to what types of things they would disqualify? Probably.
Stay up, Bavu; things are going to blow up for you - hell, you got the attention of Premier and the other judges already. Texas' time will come...

bottom line is that censorship applies to free speech; that which is spoken on your own time in public or private. his speech is NOT free when invloved in a corporatly sponsored contest in which scion clearly reserved the right to "censor" the message. Perhaps the DQ timing or tact wasn't handled properly (i am actually involved in another scion contest by inform and they are not always acting the way they should) but censorship is not a valid argument when you sign up for a contest that has already allowed itself the right to censorship in the rules. you just can't complain about censorship when you sign up for something that in it's very creation is designed to control a particular message.
